SMS Communications & Consent

BorakDesk operates a multi-tenant marketing platform that lets businesses send transactional and marketing SMS messages to contacts who have explicitly opted in to receive them. This page describes how SMS consent is collected on BorakDesk, what messages a recipient can expect, and how anyone can opt out at any time.

How SMS opt-in is collected

BorakDesk never sends SMS to anyone who has not explicitly opted in. Consent is collected through one of the following mechanisms before any SMS is sent:

  1. Web form opt-in: A visitor enters their phone number on a BorakDesk-hosted landing page or a customer's embedded form and checks an explicit consent checkbox.
  2. Account signup: A user signs up for a BorakDesk customer's product or service and checks an explicit SMS opt-in box during registration.
  3. Keyword opt-in: A person texts a keyword (for example SUBSCRIBE) to the sender number, confirming their intent to receive future messages.
  4. In-platform opt-in toggle: A BorakDesk customer manually records a contact's SMS opt-in inside the Contacts page after obtaining verifiable consent offline (signed waiver, recorded phone call, in-person sign-up).

For every method, the opt-in is logged with timestamp, source, and IP address (where applicable) so that consent can be proven on request.

Sample opt-in language

When a recipient opts in to receive SMS from a BorakDesk-powered service, they see clear, unambiguous language similar to the following:

By checking this box and providing your mobile number, you agree to receive recurring marketing and transactional SMS messages from [Business Name] at the number provided, sent via an automated dialing system. Consent is not a condition of purchase. Message frequency varies (up to 10 messages per month). Message and data rates may apply. Reply STOP to cancel at any time. Reply HELP for help. The exact wording is supplied by each BorakDesk customer for their own brand, but every opt-in form presented through the platform must include all seven required CTIA disclosures: business name, consent statement, automated-system disclosure, opt-in-not-required disclosure, frequency, rate disclosure, and opt-out instructions.

What kind of messages will recipients receive?

BorakDesk customers send the following categories of SMS:

  • Transactional: account verification, password resets, order receipts, delivery updates, appointment reminders.
  • Marketing: promotional offers, new product announcements, event invitations, newsletter highlights.
  • Operational: service status notifications, billing reminders, support follow-ups.

All messages identify the sender by business name and include opt-out instructions on the first outbound message and at least once per month thereafter.

Message frequency

Recipients can expect up to 10 messages per month from any single BorakDesk customer unless they have explicitly opted in to a higher-frequency channel (for example, real-time price alerts). Frequency is disclosed at the point of opt-in.

Message and data rates

Message and data rates may apply. SMS charges are determined by the recipient's wireless carrier and are not controlled by BorakDesk or its customers. Recipients should consult their carrier's rate plan for details.

How to opt out

Recipients can stop receiving SMS messages at any time. We support all standard opt-out keywords required by US carriers and CTIA guidelines:

  • Reply STOP to unsubscribe from all messages.
  • Reply UNSUBSCRIBE, CANCEL, END, QUIT, or OPTOUT — all are honored identically.

When BorakDesk receives any of these keywords, the contact's opt-in is revoked immediately and a one-time confirmation message is sent ("You have been unsubscribed. No further messages will be sent. Reply START to resubscribe."). No further messages are sent unless the recipient textsSTART to opt back in.

Recipients can also opt out by emailing privacy@boraksolutions.com with their phone number, or by contacting the specific BorakDesk customer that sent the message.

  • Replying HELP to any SMS — we automatically respond with sender identification and support contact information.

Regulatory compliance

BorakDesk's SMS practices comply with:

  • US Telephone Consumer Protection Act (TCPA) consent requirements.
  • US CAN-SPAM Act opt-out and sender identification requirements as applied to text messaging.
  • CTIA Short Code Monitoring Handbook and Messaging Principles & Best Practices.
  • 10DLC and Toll-Free Verification requirements imposed by US wireless carriers.
  • GDPR (EU) and PIPEDA (Canada) where contacts reside in those jurisdictions, including documented lawful basis and right to erasure.

Phone numbers and consent records are stored in the geographic region matching the contact's residency (US data in United States, EU data in Europe, Asia-Pacific data in Asia). Full details are in our Privacy Policy and Data Processing Agreement.

Will BorakDesk share my phone number?

No. BorakDesk does not sell, rent, or share phone numbers with third parties for marketing purposes. Phone numbers are used solely to deliver SMS to the recipient on behalf of the BorakDesk customer they opted in with. Carriers and SMS infrastructure providers (Twilio, ACS) see the numbers only as required to transmit the message.
